Considering Litigation?

8/1/2025 - N. McKean

If someone has harmed you, you may be able to sue. They could have hurt you physically, broke your stuff, or damaged your reputation. But if someone hurt you, the law gives us a way to try to correct the situation through a civil lawsuit (suing).

Courts only let you sue on things that are actionable, meaning only about some kinds of issues (you cannot sue your neighbor just because you don’t like their smile!). And they only let you sue if it is the right court and you are suing within a given amount of time. Basically, it comes down to the 5Ws from school - who/what/where/when/why.

It is also important to consider suing if suing is the right thing to do, if it is the best way for YOU to move forward. Law suits can be expensive. They take a long time and can be emotionally draining. And the hardest part is that you are not guaranteed to win even if you were 100% right. This can be pretty complicated. So if you have been injured and are considering suing -

TALK TO A LAWYER!!!

You don’t have to talk to us. Depending on the state and subject, we may not be able to help (we do business/employment law). But talk to a licensed attorney. This decision is hard enough on your own, you don’t have to make it harder by doing it alone.
